สิทธิมนุษยชน (อังกฤษ: human rights) เป็นหลักทางศีลธรรมหรือจารีต[1] ซึ่งอธิบายมาตรฐานตายตัวของพฤติกรรมมนุษย์ และได้รับการคุ้มครองสม่ำเสมอเป็นสิทธิทางกฎหมายในกฎหมายท้องถิ่นและกฎหมายระหว่างประเทศ[2] ปกติเข้าใจว่าเป็นสิทธิพื้นฐานที่ไม่โอนให้กันได้ "ซึ่งบุคคลมีสิทธิในตัวเพียงเพราะผู้นั้นเป็นมนุษย์"[3] และซึ่ง "มีอยู่ในมนุษย์ทุกคน"[4] โดยไม่คำนึงถึงชาติ สถานที่ ภาษา ศาสนา ชาติพันธุ์กำเนิดหรือสถานภาพอื่นใด[5] สิทธิมนุษยชนใช้ได้ทุกที่ทุกเวลาในแง่ที่เป็นสากล[1] และสมภาคในแง่ที่เหมือนกับสำหรับทุกคน[5] สิทธิดังกล่าวต้องการความร่วมรู้สึกและหลักนิติธรรม[6] และกำหนดพันธะต่อบุคคลให้เคารพสิทธิมนุษยชนของผู้อื่น[1][5] สิทธิดังกล่าวไม่ควรถูกพรากไปยกเว้นอันเป็นผลของกระบวนการทางกฎหมายที่ยึดพฤติการณ์แวดล้อมจำเพาะ[5] ตัวอย่างเช่น สิทธิมนุษยชนอาจรวมเสรีภาพจากการจำคุกโดยมิชอบด้วยกฎหมาย การทรมานและการประหารชีวิต[7]

ลัทธิสิทธิมนุษยชนมีอิทธิพลสูงในกฎหมายระหว่างประเทศ สถาบันโลกและภูมิภาค[5] การกระทำของรัฐและองค์การนอกภาครัฐก่อพื้นฐานของนโยบายสาธารณะทั่วโลก แนวคิดสิทธิมนุษยชนเสนอว่า "หากวจนิพนธ์สาธารณะสังคมโลกยามสงบสามารถกล่าวเป็นภาษาศีลธรรมร่วมได้ สิ่งนั้นคือสิทธิมนุษยชน" การอ้างอย่างหนักแน่นโดยลัทธิสิทธิมนุษยชนยังกระตุ้นกังขาคติและการอภิปรายเกี่ยวกับเนื้อหา สภาพและการให้เหตุผลว่าชอบด้วยกฎหมายซึ่งสิทธิมนุษยชนตราบจนทุกวันนี้ ความหมายแน่ชัดของคำว่า "สิทธิ" นั้นมีการโต้เถียงและเป็นหัวข้อการอภิปรายทางปรัชญาต่อไป[8] ขณะที่มีการเห็นพ้องต้องกันว่าสิทธิมนุษยชนครอบคลุมสิทธิต่าง ๆ[4] เช่น สิทธิที่จะได้รับการพิจารณาคดีด้วยความเป็นธรรม การคุ้มครองจากการเป็นทาส การห้ามพันธุฆาต เสรีภาพในการพูด[9]หรือเสรีภาพที่จะได้รับการศึกษา แต่ยังเห็นไม่ลงรอยกันเกี่ยวกับว่าสิทธิใดบ้างต่อไปนี้ควรรวมอยู่ในกรอบทั่วไปของสิทธิมนุษยชน[1] นักคิดบางคนเสนอว่าสิทธิมนุษยชนควรเป็นข้อกำหนดพื้นฐานเพื่อเลี่ยงการละเมิดที่ร้ายแรงที่สุด ขณะที่บางคนมองว่าเป็นมาตรฐานขั้นสูง[1]

ความคิดพื้นฐานดังกล่าวจำนวนมากซึ่งขับเคลื่อนขบวนการสิทธิมนุษยชนพัฒนาขึ้นหลังสงครามโลกครั้งที่สองและความเหี้ยมโหดของฮอโลคอสต์[6] จนลงเอยด้วยสมัชชาใหญ่แห่งสหประชาชาติมีมติเห็นชอบปฏิญญาสากลว่าด้วยสิทธิมนุษยชนในกรุงปารีสในปี 2491 คนโบราณไม่มีแนวคิดสิทธิมนุษยชนสากลสมัยใหม่แบบเดียวกัน[10] การบุกเบิกวจนิพนธ์สิทธิมนุษยชนอย่างแท้จริงนั้นคือมโนทัศน์สิทธิธรรมชาติซึ่งปรากฏเป็นส่วนหนึ่งของประเพณีกฎหมายธรรมชาติยุคกลางซึ่งโดดเด่นขึ้นระหว่างยุคภูมิธรรมยุโรปโดยมีนักปรัชญาอย่างจอห์น ล็อก, ฟรานซิส ฮัตชิสัน (Francis Hutcheson) และฌ็อง-ฌัก บูร์ลามากี (Jean-Jacques Burlamaqui) และซึ่งมีการเสนออย่างโดดเด่นในวจนิพันธ์การเมืองของการปฏิวัติอเมริกาและการปฏิวัติฝรั่งเศส[6] จากรากฐานนี้ การให้เหตุผลสิทธิมนุษยชนสมัยใหม่กำเนิดขึ้นในช่วงครึ่งหลังของคริสต์ศตวรรษที่ 20[11] อาจเป็นปฏิกิริยาต่อความเป็นทาส การทรมาน พันธุฆาตและอาชญากรรมสงคราม[6] โดยความตระหนักถึงความเปราะบางของมนุษย์ในตัวและเป็นเงื่อนไขก่อนความเป็นไปได้ของสังคมยุติธรรม[4]

ปรัชญา แก้

ปรัชญาตะวันตกเรื่องสิทธิมนุษยชนที่เก่าแก่ที่สุดสำนักหนึ่งมีว่าสิทธิมนุษยชนเป็นผลลัพธ์ของกฎหมายธรรมชาติ ที่มาจากเหตุผลทางปรัชญาหรือศาสนาที่แตกต่างกัน ทฤษฎีอื่น ๆ มีว่าสิทธิมนุษยชนเป็นการประมวลพฤติกรรมที่มีศีลธรรมของมนุษย์ ซึ่งเป็นผลลัพธ์ทางสังคมของมนุษย์ที่พัฒนามาจากกระบวนการวิวัฒนาการทางชีววิทยาและสังคม

มโนทัศน์ แก้

สากลนิยมกับสัมพัทธนิยมทางวัฒนธรรม แก้

ปฏิญญาสากลว่าด้วยสิทธิมนุษยชนระบุไว้ว่าสิทธิมนุษยชนใช้กับมนุษย์ทุกคนโดยเสมอกัน ไม่ว่าอยู่ที่ใด รัฐใด มีเชื้อชาติหรือวัฒนธรรมใดก็ตาม แต่ผู้สนับสนุนสัมพัทธนิยมเสนอว่าสิทธิมนุษยชนไม่ใช่สิ่งสากล และขัดแย้งกับบางวัฒนธรรมตลอดจนคุกคามการอยู่รอดของวัฒนธรรมเหล่านั้น บางคนอธิบายสากลนิยมว่าเป็นจักรวรรดินิยมทางวัฒนธรรม เศรษฐกิจหรือการเมือง โดยเฉพาะอย่างยิ่งมโนทัศน์สิทธิมนุษยชนมักอ้างว่ามีรากเหง้ามาจากทัศนะทางการเมืองแบบเสรีนิยม ซึ่งแม้ว่าโดยทั่วไปเป็นที่ยอมรับในทวีปยุโรป ญี่ปุ่นและอเมริกาเหนือ แต่มิได้เป็นมาตรฐานที่อื่น นอกจากนี้ยังมีการพาดพิงถึงนักคิดสิทธิมนุษยชนที่ทรงอิทธิพลบางคน เช่น จอห์น ล็อก และจอห์น สจวต มิล ว่าทุกคนเป็นชาวตะวันตกและบางคนยังพัวพันกับการบริหารจักรวรรดิเองเสียด้วย[12][13]

สิทธิที่นักสัมพัทธนิยมมักแย้งคือสิทธิสตรี ตัวอย่างเช่น การตัดอวัยวะเพศสตรีพบในหลายวัฒนธรรมในทวีปแอฟริกา เอเชียและอเมริกาใต้

ลี กวน ยิว อดีตนายกรัฐมนตรีสิงคโปร์ และมหาเธร์ โมฮัมหมัด อดีตนายกรัฐมนตรีมาเลเซีย อ้างในคริสต์ทศวรรษ 1990 ว่าค่านิยมแบบเอเชียแตกต่างจากค่านิยมตะวันตกมาก และมีสำนึกเรื่องความจงรักภักดีและการยอมสละเสรีภาพส่วนบุคคลเพื่อให้สังคมมีเสถียรภาพและมั่งคั่ง ฉะนั้นรัฐบาลอำนาจนิยมจึงเหมาะสมกับทวีปเอเชียมากกว่าประชาธิปไตย

Michael Ignatieff แย้งว่าสัมพัทธนิยมทางวัฒนธรรมเป็นการให้เหตุผลที่เกือบทั้งหมดมาจากผู้ครอบอำนาจในวัฒนธรรมที่มีการละเมิดสิทธิมนุษยชน และผู้ที่ถูกละเมิดสิทธิมนุษยชนล้วนเป็นผู้ไร้อำนาจทั้งสิ้น[15] สะท้อนว่าการตัดสินสากลนิยมกับสัมพันธนิยมอยู่ในมือของผู้ที่อ้างว่าเป็นตัวแทนของวัฒนธรรมนั้น ๆ
