เทศบาล

I get confused with the thesaban. เทศบาลตำบลด่านสำโรง is actually located in อำเภอพระประแดง, so shouldn't it be listed there instead. Both แพรกษา and บางเมือง are listed as both อบตำบล as well as เทศบาลตำบล - doesn't the whole tambon have thesaban status? Also the tambon ปากน้ำ, ท้ายบ้าน, บางปูใหม่, บางเมืองใหม่ and ท้ายบ้านใหม่ aren't listed in the หน่วยการปกครอง section - are these the ones which comprise เทศบาลนครสมุทรปราการ? แอนดี้ 12:07, 28 กันยายน 2005 (UTC)

As my understaning, I just got the answer from my friend. One จังหวัด has many อำเภอ, and so forth one อำเภอ has many ตำบล. These are the basic idea. In อำเภอเมือง, there is one เทศบาลนคร that will contain 3-6 ตำบล while the other ตำบล have their own องค์การบริหารส่วนตำบล (อบต.)

i.e.

• จังหวัดสมุทรปราการ มี 5 อำเภอ - อำเภอเมืองสมุทรปราการ อำเภอบางบ่อ อำเภอบางพลี อำเภอพระปะแดง อำเภอพระสมุทรเจดีย์ และกิ่งอำเภอบางเสาธง
• อำเภอเมืองสมุทรปราการ มี 17 ตำบล
• อำเภอเมืองสมุทรปราการ แบ่งการปกครอง เทศบาลนคร (ปกครองตำบล ปากน้ำ, ท้ายบ้าน, บางปูใหม่, บางเมืองใหม่, ท้ายบ้านใหม่) ขณะที่ ตำบล แพรกษา - บางด้วน - บางเมือง - บางโปรง - เทพารักษ์ มี อบต. เป็นผู้ปกครองของแต่ละตำบล

The part with จังหวัด, อำเภอ, ตำบล and finally หมู่บ้าน is more or less clear to me, except the actual tasks of the different levels, or the difference between อำเภอ and กิ่งอำเภอ. More or less what is written in the articles in the english Wikipedia is what I know. The one which I have no real idea about (and which apparently seem to be not so much well-known in Thailand as well :-) is how the เทศบาล fit into it. They way I would interpret it with my current knowledge is that several tambon make up a เทศบาลเมือง or เทศบาลนคร, usually in the อำเภอเมือง, but in some cases in other Amphoe as well. The เทศบาลตำบล however are just single tambon which have town status. And tambon who are not member of any thesaban are just plain tambon - maybe that's what สภาตำบล and อบต. (short for อบตำบล?) mean. What I haven't found yet - are always complete tambon part of a thesaban? And I haven't found a list yet which tambon belong to any of the Thesaban Nakhon/Mueang. อบต. stands for องค์การบริหารส่วนตำบล. I guess ตำบล is just a geography division of land while สภาตำบล and อบต. are for administration (just created in 2537). From what I read from www.tambol.com/tambol/default.asp, สภาตำบล is a board consisting of head of tambon, heads of all mooban, doctor of tambon, and other elected members (one per mooban). When revenue (from tax collected in area, etc) reach 150000 Baht for 3 consecutive years, สภาตำบล may be replaced by อบต. with all members from election (two per mooban, or 6 members in case tambon has less than 3 mooban). อบต. of neighbor tambon may be merged together, or merged with สภาตำบล

Duty of สภาตำบล (all optional) (copy from the above page, no copyright for code of law):

1. จัดให้มีน้ำเพื่อการอุปโภค บริโภค และการเกษตร
2. จัดให้มีและบำรุงรักษาทางน้ำและทางบก
3. จัดให้มีและรักษาทางระบายน้ำ และรักษาความสะอาดของถนน ทางน้ำ ทางเดิน และที่สาธารณะ รวมทั้งการ กำจัดมูลฝอยและสิ่งปฏิกูล
4. คุ้มครองดูแลและบำรุงรักษาทรัพยากรธรรมชาติและสิ่งแวดล้อม
5. บำรุงและส่งเสริมการประกอบอาชีพของราษฎร
6. ส่งเสริมการพัฒนาสตรี เด็ก เยาวชน ผู้สูงอายุ และ ผู้พิการ

Required duty of อบต.:

1. จัดให้มีและบำรุงรักษาทางน้ำและทางบก
2. รักษาความสะอาดของถนน ทางน้ำ ทางเดิน และที่สาธารณะ รวมทั้งกำจัด มูลฝอยและสิ่งปฏิกูล
3. ป้องกันโรคและระงับโรคติดต่อ
4. ป้องกันและบรรเทาสาธารณภัย
5. ส่งเสริมการศึกษา ศาสนา และวัฒนธรรม
6. ส่งเสริมการพัฒนาสตรี เด็ก เยาวชน ผู้สูงอายุ และผู้พิการ
7. คุ้มครอง ดูแล และบำรุงรักษาทรัพยากรธรรมชาติและสิ่งแวดล้อม
8. บำรุงรักษาศิลปะ จารีตประเพณี ภูมิปัญญาท้องถิ่น และวัฒนธรรมอันดีของ ท้องถิ่น
9. ปฏิบัติหน้าที่อื่นตามที่ทางราชการมอบหมายโดยจัดสรรงบประมาณหรือบุคลากรให้ตามความจำเป็นและ สมควร

Optional duty of อบต.:

2. ให้มีและบำรุงการไฟฟ้าหรือแสงสว่างโดยวิธีอื่น

5. ให้มีและส่งเสริมกลุ่มเกษตรกรและกิจการสหกรณ์
6. ส่งเสริมให้มีอุตสาหกรรมในครอบครัว
7. บำรุงและส่งเสริมการประกอบอาชีพของราษฎร
8. การคุ้มครองดูแลและรักษาทรัพย์สินอันเป็นสาธารณสมบัติของแผ่นดิน
9. หาผลประโยชน์จากทรัพย์สินขององค์การบริหารส่วนตำบล
10. ให้มีตลาด ท่าเทียบเรือ และท่าข้าม

Now the mist starts to clear. Luckily that law text is also available in english [1] - so those two สภาตำบล and อบต. are different kinds of administration of a tambon. I haven't read that law text in detail before, so I missed the part that several tambon can have a joint administration - which explains why some tambon are not listed in จังหวัดสมุทรปราการ (เขตการปกครอง). A เทศบาลตำบล has a องค์การบริหารส่วนตำบล as its administration? เทศบาลเมือง and เทศบาลนคร have a mayor, and a similar council (but with a different name), right? So only thing that'd be missing is the information of which tambon joined their administrations (and which belong to the thesaban mueang/nakhon), then the two sections can be merged. แอนดี้ 16:23, 5 ตุลาคม 2005 (UTC)
