ในปรัชญาศีลธรรมและการเมือง สัญญาประชาคม (อังกฤษ: social contract) เป็นทฤษฎีหรือแบบจำลองที่ถือกำเนิดขึ้นในยุคเรืองปัญญา โดยปกติ (แต่ไม่เสมอไป) จะเกี่ยวข้องกับความชอบธรรมของอำนาจหน้าที่ของรัฐเหนือปัจเจก[1]

ข้อโต้แย้งของทฤษฎีสัญญาประชาคมคือ ปัจเจกล้วนยินยอมที่จะสละเสรีภาพบางส่วนไปและมอบให้แก่ผู้ถืออำนาจหน้าที่ (อาจเป็นผู้ปกครอง หรือขึ้นอยู่กับเสียงส่วนใหญ่) ทั้งอย่างชัดแจ้งและอย่างซ่อนเร้น เพื่อแลกกับความคุ้มครองในสิทธิหรือเพื่อการธำรงไว้ซึ่งระเบียบทางสังคม[2][3] ความสัมพันธ์ระหว่างสิทธิธรรมชาติและสิทธิทางกฎหมายมักเป็นประเด็นในทฤษฎีสัญญาประชาคม ชื่อของทฤษฎีได้มาจากชื่อหนังสือสัญญาประชาคม (ฝรั่งเศส: Du contrat social ou Principes du droit politique) ใน ค.ศ. 1762 โดยฌ็อง-ฌัก รูโซ แม้ทฤษฎีนี้เคยปรากฏอยู่ในปรัชญากรีกโบราณและสโตอิก รวมไปถึงกฎหมายโรมันและกฎหมายศาสนจักร ยุคที่ทฤษฎีสัญญาประชาคมรุ่งเรืองที่สุดอยู่ในช่วงกลางคริสต์ศตวรรษที่ 17 ถึงต้นคริสต์ศตวรรษที่ 19 เมื่อได้กลายมาเป็นลัทธิสำคัญในเรื่องความชอบธรรมทางการเมือง

ในทางตรงกันข้าม ล็อกและรูโซแย้งว่ามนุษย์พึงมีสิทธิพลเมืองโดยแลกกับการต้องยอมรับ ให้ความเคารพ และปกป้องสิทธิของผู้อื่น ซึ่งทำได้โดยการยอมสละเสรีภาพบางส่วนไป[6][7][8]
