อนุสัญญานี้ สมัชชาใหญ่ตกลงรับและเปิดให้ลงนามเมื่อวันที่ 20 พฤศจิกายน ค.ศ. 1989 ซึ่งวันเป็นครบรอบ 30 ปีของ[[ปฏิญญาว่าด้วยสิทธิเด็ก]] (Declaration of the Rights of the Child)<ref name="UN_ARES4425">{{UN document |docid=A-RES-44-25 |type=Resolution |body=General Assembly |session=44 |resolution_number=25 |accessdate=22 August 2008|title=Convention on the Rights of the Child|date=20 November 1989}}</ref> อนุสัญญามีผลใช้บังคับเมื่อวันที่ 2 กันยายน ค.ศ. 1990 อันเป็นวันที่ได้รับสัตยาบันจากประเทศต่าง ๆ ครบ 20 ประเทศ ปัจจุบัน มีประเทศเข้าเป็นภาคีแห่งอนุสัญญานี้แล้ว 196 ประเทศ<ref name=untreaty>United Nations Treaty Collection.
